These updates apply to all attorneys across the state who do indigent defense work; including Private Assigned Counsel (PAC), Managed Assigned Counsel (MAC), and state-employed Public Defenders.
Note: The content is especially important for all PAC attorneys who are doing indigent work in eCourts counties.
If you have any questions, please send an email to Chad Boykin, Assistant General Counsel for IDS: [email protected]
Please read on!
IMPORTANT: Just in case you are using the prior version of the fee app, do not worry! IDS will not return the fee app just because it uses the prior version.
YOU WILL STILL BE PAID.
Part 1
First, please view this video guide, Using Fee Apps for Payment in eCourts Counties.
It explains the importance of checking the correct box at the top of the fee app, as well as what it could mean if the wrong box is checked.
***In eCourts counties, this step directly impacts the ability of IDS to issue payment for PAC services!***
Part 2
Rationale: The updates and new language used are driven by the need to function in eCourts.
The forms you use every day for payment of services and/or recoupment have some changes.
For your convenience, here are the links to our updated fee app forms:
AOC-CR-225 (Adult Criminal)
AOC-J-411 (Juvenile)
AOC-G-200 (Civil)
UPDATE #1: Defendant’s SSN
The newest versions of fee applications include updates in the section highlighted above.
This update places emphasis that the client’s Social Security Number is either:
- Provided, if recoupment is ordered,
- Does not exist, or
- That the attorney made “reasonable efforts” to obtain it but were unable to.
There is no need to redact this information since it is required by statute; the statute number and language are provided for your reference.
However! When you e-file, you must use the “Public Not Portal” so the personally identifying information (PII) is not seen by the public.
UPDATE #2: Applicant’s SSN or Tax ID Number
There is no longer a field to enter the Applicant (Attorney’s) Tax ID Number. Instead, there is a place to enter the Applicant Bar Number.
Rationale: The attorney’s PII will no longer be included when the fee app is filed.
However! If you DO use an older form and include your Tax ID Number, you must redact this and file as “public not portal.”
IMPORTANT: Just in case you are using the prior version of the fee app, do not worry! IDS will not return the fee app just because it uses the prior version.
YOU WILL STILL BE PAID.
